Terms and Conditions of Sale and Use

1. About the business

These General Terms and Conditions of Sale and Use (T&Cs) apply to all products offered on the DSWOOD online shop, published by:

David SCHUDY (DSWOOD), sole trader
SIRET: 840 018 493 00014
Email: dswood.alsace@gmail.com

Any order placed through the website implies full and unreserved acceptance of these terms and conditions.

2. Purpose

These T&Cs set out:

  • the conditions for accessing the website and the online shop;
  • the arrangements for ordering, payment, delivery and returns;
  • the rights and obligations of users;
  • the responsibilities of the publisher and of the buyer.

3. Products

The products offered are:

  • end-grain cutting boards;
  • handcrafted knives;
  • wooden accessories (small boards, slicing boards, etc.);
  • care products (wood balm).

3.1. Handcrafted character and unique pieces

Each piece is shaped by hand in our workshop in Alsace. Most boards and knives are unique pieces: each order reduces the stock to zero and the product is no longer available in the identical form.

Natural variations may exist between the photograph and the product delivered:

  • shades of colour;
  • grain of the wood;
  • patterns of the assembly;
  • very slightly different dimensions (handcraft tolerance).

These variations do not constitute a defect and are inherent to the natural and handcrafted nature of the product.

3.2. Product information

Descriptions, dimensions, photos and characteristics are provided with the greatest care and remain indicative, within the limits of the natural specificities of wood.

4. Prices

The prices displayed are expressed in euros (€) inclusive of all taxes, excluding delivery costs.

DSWOOD reserves the right to change its prices at any time, but products will be invoiced on the basis of the price in force at the time the order is confirmed.

5. Orders

Any order constitutes acceptance of the prices and descriptions. Once it is confirmed:

  • the customer receives an automatic confirmation email;
  • the product is removed from stock (unique pieces cannot be reordered);
  • the order can no longer be changed, except by exceptional agreement obtained by email before dispatch.

DSWOOD reserves the right to cancel an order in the event of:

  • inability to collect payment;
  • a fraudulent order or suspected fraud;
  • an obvious logistical problem.

5.1. Engraving and personalisation

Cutting boards can be ordered with a custom engraving (€4 supplement, free text of up to 30 characters). Once confirmed, this personalisation is final and cannot be changed, and excludes the product from the right of withdrawal (see section 8).

6. Payment

Payment is made online through the secure platform Shopify Payments, as well as by the other means offered at checkout (bank card, Apple Pay, Google Pay, PayPal depending on configuration).

Bank details never pass through DSWOOD’s servers and are processed exclusively by PCI-DSS certified payment providers.

The customer warrants that they hold the necessary authorisations to use the chosen means of payment. No order will be shipped before full payment.

7. Delivery

7.1. Preparation and dispatch times

As each piece is shaped by hand, 3 to 7 working days are needed to prepare the order before dispatch. Products with a custom engraving require an additional 2 to 4 working days.

7.2. Carriers and areas

Parcels are sent by Colissimo or Mondial Relay, with tracking and signature for fragile pieces. DSWOOD ships to mainland France, Corsica, Belgium, Luxembourg, Switzerland and Germany.

7.3. Delivery costs

Costs are shown when the order is confirmed and vary according to weight, destination and delivery method.

7.4. Tracking

The buyer receives a tracking number by email when the parcel is dispatched.

7.5. Receipt

The customer is responsible for checking the condition of the parcel on delivery. In the event of visible damage, a complaint must be made to DSWOOD within 48 hours, accompanied by photographs.

Full details are set out on the Delivery & returns page.

8. Right of withdrawal

Under Articles L.221-18 et seq. of the French Consumer Code (Code de la consommation), you have 14 days from receipt of the product (or of the last product, if your order is delivered in several parcels) to exercise your right of withdrawal, without having to give any reason or pay any penalty.

To exercise it, notify us of your decision by means of an unambiguous statement, by email to dswood.alsace@gmail.com or by post to DS Wood Alsace, 39 rue Clemenceau, 67650 Dambach-la-Ville, France. You may use the model withdrawal form reproduced in the annex, but you are not obliged to do so.

You must send the product back to us no later than 14 days after you have notified us of your decision, in its original packaging, in good condition and together with the invoice. The cost of returning the product is at your expense, except where the product is defective or we have made a mistake. You are only liable for any diminished value of the product resulting from handling other than what is necessary to establish its nature, characteristics and functioning.

Exception (Article L.221-28 of the French Consumer Code): the right of withdrawal cannot be exercised for products made to your specifications or clearly personalised (custom engraving, a piece made to measure at your request).

Refund: we will reimburse all payments received from you, including standard delivery costs, without undue delay and no later than 14 days after we are informed of your decision, using the same means of payment as you used for the order. We may withhold the refund until we have received the product or until you have provided proof that you have sent it back.

9. Returns, defective products and refunds

The arrangements for returns and refunds under the right of withdrawal are described in Article 8.

If your order arrives damaged or has a defect, contact us at dswood.alsace@gmail.com with photographs of the product and of the packaging. The cost of returning the product is then at our expense, and we will, as the case may be, replace, repair or refund the product.

10. Guarantees

DSWOOD products benefit from:

  • the statutory guarantee of conformity (Articles L217-4 et seq. of the French Consumer Code);
  • the guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code).

As wood is a living material, the following do not constitute defects:

  • small natural surface cracks;
  • slight deformations caused by ambient humidity;
  • variations in colour or grain;
  • marks resulting from normal use.

11. Care and liability

The customer is responsible for looking after the product properly. Recommendations are set out on the Advice & care page. In particular:

  • do not put it in the dishwasher;
  • do not immerse it in water;
  • clean it with warm soapy water;
  • nourish the board regularly with our wood balm;
  • do not use it as a trivet.

DSWOOD cannot be held liable for damage resulting from poor care, misuse or extreme storage conditions.

12. Intellectual property

All elements of the website (texts, photos, products, designs, logos) are protected by copyright. Any reproduction, even partial, is prohibited without prior written permission.

13. Personal data

The management of personal data is described in the privacy policy.

To exercise your rights (access, rectification, erasure): dswood.alsace@gmail.com.

14. Use of the website

The user undertakes:

  • not to disrupt the proper functioning of the website;
  • not to attempt to access it fraudulently;
  • not to use the content for unauthorised commercial purposes.

15. Force majeure

DSWOOD cannot be held liable for a failure resulting from force majeure (strike, natural disaster, transport problem, pandemic, etc.).

16. Governing law and jurisdiction

These T&Cs are governed by French law. In the event of a dispute, the French courts shall have sole jurisdiction.

17. Consumer mediation

Under Articles L.612-1 et seq. of the French Consumer Code, in the event of a dispute the customer may use the following consumer mediator free of charge:

MÉDIATION CONSOMMATION DÉVELOPPEMENT
C/O Centre d'Affaires Stéphanois, IMMEUBLE L'HORIZON
ESPLANADE DE FRANCE, 3 RUE J. CONSTANT MILLERET
42000 SAINT-ÉTIENNE

After first contacting the seller in writing, the consumer may refer any unresolved dispute to the mediator.
